Terms of Service

1. Agreement
By creating an account or using any service at khansland.com.bd or its subdomains (collectively "Khansland"), you agree to these Terms of Service. If you do not agree, do not use Khansland.
These terms apply to all Khansland services including Gigs, Shop, Meal, Euro, and any other service we offer under the khansland.com.bd domain.

2. Eligibility
You may use Khansland if:
- You are at least 18 years old, OR you are at least 13 years old and have permission from a parent or legal guardian
- You can form a legally binding contract under Bangladesh law
- You are not barred from using our services under applicable law
- You provide accurate registration information
We may refuse service to anyone for any lawful reason at our discretion.
3. Your account
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use
- One person, one account — multiple accounts may be merged or terminated
- You may not transfer your account to another person without our written consent
4. Acceptable use
You agree not to use Khansland to:
- Violate any law of Bangladesh or the country you are accessing from
- Infringe anyone's intellectual property, privacy, or other rights
- Generate, publish, or distribute content that is:
- Illegal, defamatory, or fraudulent
- Sexually explicit involving minors
- Inciting violence, terrorism, or hatred against protected groups
- Spam, deceptive, or designed to manipulate financial markets
- Malware, phishing, or otherwise harmful to computer systems
- Misrepresent your identity or affiliation with any person or organization
- Reverse engineer, scrape, or attempt to extract source code from Khansland
- Resell our services without written permission
- Attempt to bypass payment, rate limits, or other technical controls
- Use AI-generated content to deceive others about its origin in contexts where this matters (e.g., academic submission, journalism, legal proceedings)
We may suspend or terminate your account for any violation, and may report illegal activity to authorities.
5. AI-generated content (Gigs)
Khansland Gigs uses third-party AI providers to generate content based on your input.
Important things to understand:
- AI output may contain errors, inaccuracies, or fabricated information ("hallucinations"). You are responsible for reviewing all output before using or publishing it.
- AI output is not legal, medical, financial, or professional advice.
- We do not guarantee any specific quality, accuracy, or fitness for purpose of AI output.
- Identical or similar inputs may produce identical or similar outputs for different users — AI output is not always unique.
- Some AI output may inadvertently resemble copyrighted works. You are responsible for checking for infringement before commercial use.
Ownership of AI output:
- You own the prompts you submit
- Subject to applicable law, you may use the AI output you generate for any lawful purpose, including commercial use
- We do not claim ownership of your generated content
- You grant us a limited license to store, process, and display your content as needed to provide the service
- We may retain anonymized, aggregated usage data to improve the service
Credits and payment:
- Generations consume credits from your wallet
- Credits are non-refundable except where required by law
- Failed generations (technical errors on our side) are refunded automatically
- Generations rejected for policy violations are not refunded
- Credit balances do not expire but are non-transferable
6. Social media publishing (Gigs)
When you connect a third-party social media account (e.g., Facebook Page) to Khansland:
- You confirm you have the legal right to post to that account
- You are solely responsible for all content posted to your accounts via Khansland
- We act only on your explicit instructions to publish
- We are not responsible for posts that fail to publish due to third-party platform issues, expired tokens, or platform policy violations
- You agree to comply with the third-party platform's own terms of service
- If a platform suspends your account due to content you posted via Khansland, that is between you and the platform
7. Payments
- Prices are in Bangladesh Taka (৳) unless stated otherwise
- Payments are processed via bKash and other approved channels
- All sales are final unless required otherwise by law
- We may change prices at any time with at least 7 days' notice for active subscriptions; one-time purchases are at the price shown at checkout
- You are responsible for any taxes or fees applicable to your transactions
8. Marketplace transactions (Shop, Meal, etc.)
For platforms where Khansland connects buyers and sellers:
- Khansland is a marketplace platform, not the seller of merchandise listed by third parties (unless explicitly marked as sold by Khansland)
- Disputes between buyers and sellers are primarily between those parties
- We provide a dispute resolution process but make no guarantee of outcome
- Sellers are responsible for the legality, quality, safety, and accuracy of their listings
- Buyers are responsible for reviewing listings before purchase
9. Intellectual property
Our content: The Khansland platform, including its design, code, logos, written content (excluding user-generated content), and trademarks, is owned by Habib Khan / Khansland. You may not copy, modify, distribute, or create derivative works without written permission.
Your content: You retain ownership of content you create or upload. By posting content, you grant Khansland a worldwide, non-exclusive, royalty-free license to host, display, and process that content as necessary to provide the service. This license ends when you delete the content (except for content already shared with others or required by law to retain).
Reporting infringement: If you believe content on Khansland infringes your copyright, email support@khansland.com.bd with: the work claimed, the location on Khansland, your contact information, and a statement of good-faith belief.
10. Service availability
- We aim for high availability but do not guarantee uninterrupted service
- We may perform maintenance with or without notice
- We may modify, suspend, or discontinue any service or feature at any time
- For paid services, we will provide reasonable notice of discontinuation and refund unused credits where applicable
11. Termination
By you: Delete your account at Settings → Account → Delete, or email us. Deletion takes effect within 30 days. Some data may be retained for legal compliance (see Privacy Policy).
By us: We may suspend or terminate your account for:
- Violating these Terms
- Fraudulent activity
- Posing risk to other users or the service
- Long inactivity (with notice)
- Legal requirement
Upon termination, your right to use Khansland ends immediately. Provisions that by their nature should survive (intellectual property, disclaimers, liability limits, dispute resolution) will survive termination.
12. Disclaimer of warranties
Khansland is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be uninterrupted, secure, or error-free
- Defects will be corrected
- The service is free of viruses or harmful components
- AI output will be accurate, complete, or appropriate for any specific use
13. Limitation of liability
To the maximum extent permitted by law, Habib Khan and Khansland shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, business opportunity, or goodwill
- Damages exceeding the amount you paid us in the 12 months preceding the claim
This applies even if we were advised of the possibility of such damages.
Some jurisdictions do not allow limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Habib Khan and Khansland from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third party's rights
- Content you submit, post, or transmit through the service
15. Dispute resolution
These Terms are governed by the laws of Bangladesh.
Any dispute arising from these Terms or your use of Khansland shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be submitted to the courts of Pabna, Bangladesh, which shall have exclusive jurisdiction.
You agree to bring claims only in your individual capacity, not as a class action.
16. Changes to terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of Khansland after changes take effect constitutes acceptance.
17. Miscellaneous
- Severability: If any provision is held unenforceable, the rest remains in effect
- No waiver: Our failure to enforce any right is not a waiver of that right
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Khansland
- Assignment: You may not assign your rights under these Terms; we may assign ours with notice
- Force majeure: Neither party is liable for delays caused by events beyond reasonable control
